After submitting the registration link, it is defaulted that you will participate in the "XPENG New Vehicle Infotainment System Experience Project" of Guangzhou XPENG Auto Technology Co., Ltd., with a project duration of 3 months. Since the relevant information of the new vehicle infotainment system of this model has not been publicly released yet and is an absolute business secret and confidential matter of the XPENG , in accordance with relevant national and local laws and regulations, the following commitments are made to the XPENG regarding the confidentiality of this project:

Ⅰ. Content of Trade Secrets

    The Participant clearly understands that the trade secrets and confidentiality content referred to in this Commitment Letter include but are not limited to:

    The UI and interaction methods, functionality and performance, version configuration details, experience research conversation information, etc. of XPENG's new vehicle infotainment system, as well as all information and data materials obtained by the individual through or based on the experience project via XPENG or the experience products and systems provided by XPENG. The carriers of confidential information include but are not limited to paper documents, electronic data, oral communication content, etc.

II. Confidentiality Obligations

    1. Without the written consent of XPENG, the Participant shall not directly or indirectly disclose, reveal, provide, or mention any Confidential Information to anyone; nor shall the Participant make any comments regarding XPENG's new vehicle infotainment system to anyone; including but not limited to by means of taking photos, shooting videos, LIVE streaming, recording audio or video, accepting interviews, publishing articles or comments, or any other form of external disclosure and dissemination; "anyone" in this Article includes but is not limited to: relatives and friends, XPENG competitors, customers, the media, and any other third parties other than non-Participants; The term of the confidentiality obligation shall commence on the date the Participant participates in the XPENG 's new vehicle infotainment system experience project and end on the date the system experience project terminates.

    2. Participants shall ensure that they do not privately intercept, retain, use, study, reproduce, copy, or possess any relevant document information materials related to confidential information, regardless of whether it is for profit, non-profit, or personal research and learning purposes. If they have obtained document information materials before the termination date of the system experience project, they shall voluntarily return or transfer them to XPENG.

III. Liability for Breach of Commitment

    The Participant agrees that if it violates the content of this Commitment Letter, it will promptly take remedial measures as required by XPENG (including but not limited to taking measures to reduce losses or adverse impacts, offering apologies, eliminating negative impacts, etc.); if it causes losses to XPENG (including but not limited to direct losses, indirect losses, and all expenses incurred in connection with claims such as evidence collection fees, litigation fees, etc.), the Participant shall voluntarily assume full liability for compensation; if it is suspected of committing a crime, it shall bear criminal liability in accordance with the law. 

    The Participant fully understands and agrees to all of the above content, and comply with this commitment letter .
